PERSONAL USE LIMIT FOR DRUGS AND STIMULANTS
MOST SEIZED DRUG TYPES IN TURKEY

Heroin
Considering that the average dose amount is (0.01-0.02) grams and the number of daily doses is consumed as 4-6, it is understood that net 6.5 grams of heroin corresponds to 65 days of use, and it is evaluated that this is within the amount of personal use. (Criminal General Assembly 2020/104 E. 2022/444 K.) However, the fact that it is found in an amount that meets approximately 83 days of need is evaluated as far above the amount of personal need. WEED
Although it is generally accepted that cannabis use up to 600-700 grams is within the limits of personal use, the highest amount accepted by the Court of Cassation within the limits of personal use is 577.10 grams. (Court of Cassation 20th Criminal Chamber 2015/1538 E. , 2015/4362 K.)
ROOT CANNABIS
If there is no other evidence that they are planted for commercial purposes, it is accepted that up to 20 roots of planted cannabis are planted for personal use. (10th Criminal Chamber 2019/4267 E. 2019/9062 K.)
COCAINE
The drug substance, which is 5 grams gross and 1.64 grams net, is sufficient for 50-60 uses and is within the limits of personal use. 10th Criminal Chamber 2020/2389 E. 2021/7188 K.)
MDMA
87 ecstasy pills containing MDMA fall within the personal use limit (Court of Cassation 10th Criminal Chamber 2010/37872 E. 2014/2770 K.)
METAMFETAMİNE
It was evaluated that the total net 11,172 grams of methamphetamine did not exceed the personal use limits. (10th Criminal Chamber of the Court of Cassation 2020/15691 E., 2020/9450 K.)
SYNTHETIC CANNABINOID (BONSAI)
It is accepted that the substance Bonzai can be smoked 1-2 times a day and consumed around 0.2 to 0.4 grams per use, therefore, synthetic cannabinoids seized over 25 grams are considered to be possessed for commercial purposes.
SYNTHETIC PHARMACEUTICALS / MEDICINES
40 synthetic drug pills are accepted to be within the limits of use. (10th Criminal Chamber 2015/5537 E. 2015/33109 K.)
CONCLUSION
The above-mentioned amounts and the decisions of the Court of Cassation are important in cases where there is no circumstantial evidence and only the quantity of drugs is considered in the proceedings. Therefore, if there are indications that the offence has been committed, such as informant information, witness statement, camera recording, many small sachets, sensitive scales contaminated with substance, customer search, bargaining, showing samples, such as a behaviour to sell or transfer or supply the narcotic substance to another person, even if the narcotic substance remains within the limits of personal use, punishment is imposed for the crime of manufacturing and trafficking in drugs or stimulants.
